1. General provisions
1.1. This document (the "Terms and Conditions") sets out the rules for using the website https://haipixel.md (the "Site") and the contractual terms between Pixel Group Prime SRL, as Operator, and any person who accesses the Site, makes a booking or uses the Hai Pixel services (the "User" or the "Client").
1.2. Hai Pixel is an entertainment arena with an interactive LED floor, located in Chișinău, offering, for a fee, game sessions, birthday party packages, corporate and team-building events, as well as gift cards (the "Services"). The Services are provided at the Operator's physical venue, and bookings are made online through the Site or through other channels made available by the Operator.
1.3. By accessing the Site, making a booking or using the Services, the User confirms having read, understood and fully accepted these Terms and Conditions. Users who do not agree with them are asked not to use the Site and the Services.
1.4. Definitions:
- •Operator: Pixel Group Prime SRL, the legal entity that administers the Site and provides the Services;
- •User / Client: any natural or legal person who accesses the Site or uses the Services;
- •Services: game sessions, birthday packages, corporate events, gift cards and any other services offered by the Operator;
- •Booking: a request for a date, time and package, submitted by the Client through the Site or other channels;
- •Order: the confirmed and paid booking, which forms the contract between the Operator and the Client.
1.5. The Services involve physical activity (running, jumping, movement) and are intended for all ages. Minors may use the Services only with the consent of a parent or legal guardian and under the supervision of a responsible adult, under clauses 4.7-4.10. By making a booking for a minor, the adult declares that they have the authority to act on the minor's behalf.
1.6. The Operator reserves the right to amend these Terms and Conditions at any time. The applicable version is the one published on the Site at the time the booking is made. Amendments take effect from the date of publication on the Site.
2. Personal data protection
2.1. The Operator processes Users' personal data in accordance with the legislation of the Republic of Moldova, in particular Law no. 133/2011 on personal data protection (currently in force) and Law no. 195/2024 on personal data protection, which transposes Regulation (EU) 2016/679 (GDPR) and enters into force on 23 August 2026.
2.2. The Operator collects and processes data strictly for the purposes for which it was provided, such as: managing bookings and orders, processing payments, communicating with the Client, issuing fiscal documents, providing support and, with the Client's consent, sending marketing communications.
2.3. The data collected may include: first and last name, phone number, e-mail address, data required for payment processing and booking details (date, time, number of participants). The Operator does not store full bank card data; payments are processed by the payment service provider.
2.4. The data subject has, under the law, the right of access to data, rectification, erasure, restriction of processing, objection and portability, as well as the right to lodge a complaint with the National Center for Personal Data Protection (CNPDCP).
2.5. Full details on legal grounds, storage periods, recipients and the exercise of rights are set out in the Privacy Policy and the Cookie Policy.
3. Placing and paying for an order
3.1. Services are booked online through the Site's booking section, where the Client chooses the type of experience (Pixel Game, Birthday Party, Corporate Event), the date, time, duration and number of participants. Bookings may also be made through other contact channels communicated by the Operator.
3.2. After completing the requested details, the Client receives a booking confirmation by e-mail and/or another indicated means of communication. The order is considered concluded, and the contract between the Operator and the Client formed, upon confirmation of the booking and, where applicable, receipt of payment.
3.3. Service prices are displayed on the Site in Moldovan lei (MDL) and include applicable taxes, unless stated otherwise. The Operator reserves the right to change prices; the price applicable to an order is the one displayed at the time the booking is confirmed.
3.4. Payment can be made online by bank card through the payment services provided by maib (Visa, Mastercard and American Express cards are accepted), as well as through other methods made available by the Operator. Online transactions take place in a secure environment provided by the payment processor.
3.5. Gift cards can be purchased through the Site and used to pay for the Services, within the value and validity period indicated. Gift cards are not redeemable for cash, except where required by law.
3.6. Upon request, the Operator issues the fiscal document for the order, in accordance with the legislation in force. The Client is responsible for the accuracy of the details provided at booking.
4. Service delivery
4.1. The Services are provided at the Operator's venue in Chișinău, indicated on the Site, on the date and at the time confirmed by the booking. "Delivery" consists of providing the Client access to the booked experience within the agreed time slot.
4.2. Opening hours are daily from 10:00 to 22:00, subject to any changes communicated on the Site. Clients are advised to arrive a few minutes before the booked time so the full session duration can be honoured.
4.3. The session duration and the contents of each package (number of participants, included games, access to the private space, add-ons) are those described on the Site at the time of booking.
4.4. The Client's late arrival does not extend the session and does not entitle the Client to a refund for unused time, except in cases attributable to the Operator.
4.5. Gift cards are delivered electronically, to the e-mail address indicated at purchase.
4.6. For safety and the smooth running of the activity, participants are asked to observe the venue rules (for example, appropriate footwear or socks, as instructed by staff), staff instructions and conduct standards. The Operator may refuse or interrupt access in the event of non-compliance with safety rules, inappropriate behaviour or a condition that endangers the participant or others.
4.7. The supervision of minors and care for their safety rest with the parent, the legal guardian or the adult to whom they have entrusted the minor (the “accompanying adult”), for the entire time the minor is present, both inside the Hai Pixel space and outside it, including the Baby Hall area, corridors, stairs and the other common areas of the building. This also applies on arrival, while waiting, during breaks and time at the table, and on departure.
4.8. Children under 6 must be accompanied at all times by an adult who is present at the venue.
4.9. For birthday parties and group events, the Client who made the booking (the organiser) ensures that every participating minor is supervised by a parent, a legal guardian or an accompanying adult, and informs the accompanying adults of these rules. For organised groups (for example schools or camps), the supervision of minors rests with the teachers, counsellors or chaperones appointed by the organiser.
4.10. Hai Pixel staff, including the animator provided by the Operator where one is ordered, run the games, give safety instructions and may interrupt the activity, but do not take over the supervision or custody of minors and do not provide childcare services. The presence of staff does not transfer to the Operator the supervision obligation set out in clause 4.7.
5. Right of return (cancellation, rescheduling and refunds)
5.1. The services offered by Hai Pixel are leisure services tied to a specific date and time slot. For such services, the 14-day withdrawal right that normally applies to distance contracts does not apply, since performance is scheduled for a precise calendar date, in accordance with consumer protection legislation.
5.2. Nevertheless, the Operator offers Clients the possibility to cancel or reschedule a booking under the following conditions:
- •Free cancellation / rescheduling: at least 48 hours before the booked date and time for parties and events, and at least 24 hours before for game sessions;
- •Late cancellation: below the above thresholds, the Operator may retain, in full or in part, the advance payment or the booking value, to cover the blocked slot;
- •No-show: failure to arrive at the booked time without prior notice does not entitle the Client to a refund.
5.3. If the Service cannot be provided for reasons attributable to the Operator (for example, technical failure, venue unavailability), the Client is entitled, at their choice, to reschedule the booking or to a full refund of the amounts paid.
5.4. Cancellation, rescheduling or refund requests are submitted through the contact channels listed in the "Contact details" section. Refunds are made using the same payment method used for the purchase, within the period set out in the Refund Policy.
5.5. Detailed refund conditions are set out in the Refund Policy, which supplements this section.
5.6. This section does not affect the Client's rights under Law no. 105/2003 on consumer protection, including the right to remedy or to compensation in the case of a non-conforming service.
6. Privacy
6.1. The Operator respects the confidentiality of Users' data and processes it exclusively for the purposes described in this document and in the Privacy Policy, under Law no. 133/2011 and, from 23 August 2026, Law no. 195/2024 on personal data protection.
6.2. Personal data is collected for specified, explicit and legitimate purposes: making and managing bookings, processing payments, communicating with the Client, fulfilling legal and fiscal obligations and, with the Client's consent, marketing.
6.3. The Operator applies reasonable technical and organisational measures to protect data against unauthorised access, loss or disclosure. Data may be transferred to service providers (for example, the payment processor, the Site's hosting provider), who process it on behalf of the Operator under confidentiality obligations.
6.4. Data is kept only for the period necessary to fulfil the purposes for which it was collected or for the period required by legal obligations.
6.5. The User may exercise their rights (access, rectification, erasure, restriction, objection, portability) and may lodge complaints with the National Center for Personal Data Protection (CNPDCP).
6.6. Full information is available in the Privacy Policy, and the use of cookies is described in the Cookie Policy. These documents form an integral part of these Terms and Conditions.
7. Liability and limitations
7.1. Hai Pixel services involve physical activity on an interactive floor. Participants take part at their own risk and declare that their state of health allows the specific physical effort. Persons with medical conditions are advised to consult a doctor before participating.
7.2. The Operator takes reasonable measures to ensure safety but is not liable for damage resulting from non-compliance with venue rules or staff instructions, from participants' reckless behaviour or from undeclared pre-existing medical conditions.
7.3. Responsibility for supervising minors, inside the Hai Pixel space and outside it, including the Baby Hall area and the other common areas of the building, lies with the parent, the legal guardian or the accompanying adult, under clauses 4.7-4.10. The Operator is not liable for damage caused by the absence or insufficiency of supervision of minors. This provision does not exclude the Operator's liability for damage caused by its own fault, in cases where the law does not permit such a limitation.
7.4. The Operator is not liable for personal items lost, damaged or left on the premises, except where required by law.
7.5. The Site is provided "as is". The Operator makes reasonable efforts to keep the Site functioning correctly and without interruption but does not guarantee the absence of errors, technical interruptions or temporary unavailability.
7.6. The Operator is not liable for the non-performance or improper performance of obligations caused by force majeure or fortuitous events (for example, natural disasters, utility outages, restrictions imposed by authorities).
7.7. To the extent permitted by law, the Operator's liability towards the Client is limited to the amounts actually paid by the Client for the Service in connection with which the damage occurred. This clause does not limit liability in cases where the law does not permit such limitation.
8. Intellectual property
8.1. All elements of the Site and of the Hai Pixel brand, including the name, logo, trademarks, texts, images, graphic and video materials, structure, design, game content and software, are the property of Pixel Group Prime SRL or its licensors and are protected by copyright and intellectual property legislation.
8.2. Reproducing, distributing, modifying, publishing or using the Site's content in any way, for commercial or other purposes, without the Operator's prior written consent, is prohibited.
8.3. Use of the Site does not grant the User any intellectual property rights over its content.
8.4. During events and sessions, the Operator may take photographs and video recordings. These may be used for promotional purposes only in compliance with personal data protection legislation and, where applicable, based on the consent of the persons concerned. The Client may at any time ask not to be photographed or filmed, and may withdraw previously given consent.
9. Governing law and dispute resolution
9.1. These Terms and Conditions, and the relationship between the Operator and the Client, are governed by the legislation of the Republic of Moldova, in particular the Civil Code of the Republic of Moldova and Law no. 105/2003 on consumer protection.
9.2. The Operator and the Client will make efforts to resolve any disagreement amicably. Complaints may be submitted to the Operator through the channels listed in the "Contact details" section; the Operator will review them and respond within a reasonable time.
9.3. The consumer has the right to address the competent consumer protection authority of the Republic of Moldova, the State Inspectorate for the Supervision of Non-Food Products and Consumer Protection (consumator.gov.md), or to use alternative dispute resolution mechanisms.
9.4. If a dispute cannot be resolved amicably, it will be submitted to the competent courts of the Republic of Moldova.
